Honestly, the "wear their underwear outside their tights" crowd is pretty well accepted worldwide where we're from, not just in Gotham. Between that and the actual supervillains wrecking regular havoc, arresting an eccentric billionaire for the way he chooses to spend his money is pretty low on the priority list.
